North Carolina joins New York in enacting Raise the Age legislation (pending implementation).

Over the past two years, four states have passed legislation to raise the age of delinquency jurisdiction and join the majority of states that have historically set the age boundary at 17, notwithstanding age and offense transfer exceptions.

  • 6/6/16, South Carolina's Act 268 was signed to raise the age through age 17, effective 7/1/19.

  • 6/14/16, Louisiana's Act 501 raised the age through 17 for some youth effective 7/1/18, and others effective 7/1/20.

  • 4/10/17, New York's A3009C raised the age through 16 effective 10/1/18, and through age 17 effective 10/1/19.

  • 6/28/17, North Carolina's SL2017-57 raised the age through 17, effective 12/1/19.

As of July 2020, only five states will prosecute law violations of a 17-year-old the same as an adult (Georgia, Michigan, Missouri, Texas and Wisconsin).

Explore the GPS Age Boundaries of Delinquency topic and compare those policies to age and offense-specific transfer provisions in each state.
